Write formally to the other party explaining that you hold them liable for all damages and emphasising that they have already changed their story and thus should it go to court they would have to explain why their version changed. Your are willing to settle out of court by full payment of all costs .

By reclaiming all your costs you will then be able to have the claim on your insurance in effect set aside as all costs have been recovered from the other party. Your insurer views that as you have reported the incident you have made a claim and thus your premiums will no doubt go up significantly ( mine doubled )

I appreciate it, but it really isn't worth the effort for what little damage there is. If they do try to increase my premiums beyond the average - which will be after the claim has closed - they will have questions to answer then. Until then, this has caused far more grief than I want to deal with right now (still recovering from major eye surgery and a baby 4 days overdue now).

Problem is, if I now say I want to claim, then I'm changing my story which obviously doesn't look good. I had the ambulance chasers the other day, demanding full details of my friend who was driving in case he was injured "as it is legally required" - for insurance, perhaps, for ambulance chasers, no. If they were entitled to the information then they could have gotten that from the insurer directly, not by threatening me with meaningless garbage.

The letter they sent which arrived today thanked me for my six page photo and drawing essay which gave full details of everything. And then went on to ask for photos, drawings and a description of the incident. This is the kind of gross incompetence I'm banging my head against a brick wall about. The letter I've sent back is polite but suggests that they read the original submission again which I have again enclosed, and gives them page references for each question they have asked (quite vague questions really).

I think you will find as far as your insurance company is concerned you have made a claim - and thats probably how the ambulance chasers got your details. I'm still getting the test messages telling me I can claim 4500 against the other party which in my case was a river - but of course what they want you to do is sign up to a credit hire company for a replacement car that will be v expensive etc

MY claim was with Direct Line and I have to say that I was a) flabbergasted that driving into a river (ford) they would pay out anything and b) they were very efficient. I have just recovered the other sizeable amount we had on GAP insurance as well but the downside is that my premiums have gone from 400£ on a big Merc to 900£ on a old civic worth 1/10th of the value - their logic is that I am a higher risk
just waiting to see what this years premiums will be
