The use of the warning horn is this manner is in direct contravention of the following section of the rule book module TW1 Preparation and movement of trains - General.

Clause 10.2 of the above listed section of the rule books states the following....

10.2 Using the warning horn.

a) General

Person responsible :- Driver

You must not use the horn more than is necessary to give an effective warning or to make sure that safe working takes place.

As can be clearly seen there is no people on or near the line, and if there was a person in such a position of danger the prescribed warning is a series of short urgent danger warnings. The playing of a tune such as does not constitute an effective warning nor a urgent danger warning.

If I was this gentlemans owning competancy manager I would be considering the temporary withdrawal of his license to drive trains pending a further length of time at the training school on the basis that he is no longer competent in the requirements of this particular section of the rules and regulations applicable to the post of a professional train driver, if not a visit from the local noise pollution officer from the local council.

Amazing Tones... problem is nowadays drivers are more careful because of inspectors and the 'bosses'

I personally don't think it should be a problem to sound ya horn whenever you want to

Once was on a Woodford Halse - Neasden freight with a WD loco fresh out of shops when it started to sound short blasts on the whistle spontaneously. After about 25 miles it stopped doing it. Never did find out why.

"You must not use the horn more than is necessary to give an effective warning or to make sure that safe working takes place."

The driver did not want to give an effective warning as there was no-one there.
I cannot find it anywhere in the rule-book where it says: You must not use the horn except in those circumstances which are printed.

Right so on that basis that is a straight forward case of non compliance with the group stardards applicaple to his license to drive trains, and I then would be even quicker to have the driver in on a form 1 charge and have him taken off track with competency not proven. And if he could see nothing wrong with his actions then send it to a full panel with a view to a permanent withdrawal of both license and safety critical work card.

i'd be a bit concerned about the possible distraction caused when "playing" fairly long sequences such as that. I didn't mind the "A-team" driver's tune quite so much as it was over quickly but this one gave the impression of someone bored to distraction

I work in a regulated industry and whenever something new comes up I try to see things from the point of view of any external and/or public inspectors that come in and the worst has happened. Would they see us as trying our absolute hardest to avoid any problems?

When applied to this I think people would be appalled to find the driver was knocking out a tune and happened to knock someone down on crossing

Yes but hitting someone on a crossing cannot be avoided most of time anyway

Isn't it strange how we all aspire to be signallers which by its very nature is a job that has to be very strictly bound by rules and regulations yet the minute any sort of rules or regulations for anything else (Forum, drivers playing tunes . . . ) are mentioned there is an immediate uprising and a number of posts appear either questioning the need for the rules in the first place or implying that anyone who falls in behind the rules is a jobsworth.

I agree, although would be a shame if the subsequent inquiry had to consider whether the pedestrian themselves were distracted by the tune... maybe not even hit by the train playing the excessive tune but by one coming the other way -- stretching things into ever more unlikely scenarios but in some jobs/roles it's better to try and act as professionally as possible all the time while on duty so there can be no question of your behaviour being a contributing factor

The more rules there are then the less scope there is for independent thought.

What about the Virgin driver who was caught, by the TM, pleasuring his self over a dirty mag whilst driving the train? The driver reported himself because he thought the TM was going to do it, but didn't. The driver still works for VT's!
