The Rail Accident Investigation Branch (RAIB) has released its report into a fatal accident at Kings Mill No.1 level crossing, near Mansfield, on 2 May 2012. The RAIB has made one recommendation.

The Rail Accident Investigation Branch (RAIB) has today released its report into a dangerous occurrence involving engineering possession, near Dunblane, Scotland 28 October 2012. The RAIB has identified three learning points.

Ridiculous but it highlights a general problem with our jusitce system, too much of it is about vengance (and tbh I bet the fact it happened in Liverpool made a difference, they are REALLY into their vengence and general emotion around there (I won't go into any more details after seeing what happened when BoJo tried it!).

To me, the only way a railway employee should be being prosecuted for an accident caused mostly or solely by his or her actions is if he or she was malicious, or was INCREDIBLY reckless. Neither apply here.

That is a very small subset though of my general contempt for the justice system, and only a tiny part tbh.

Yes, it is a shame for the families that they don't get their pound of flesh. But one doesn't have a blank pass to act like a savage just because one is bereveaved (in the long term - actually another consequence of my beliefs would be that the family would not have been punished much if they had set upon the guard immediately after the incident).

Put another way:

Before the guard was sentenced, a young girl's life was literally destroyed, and those of her family and friends etc were damaged in amounts between severe and minimal.

After sentencing the guard, none of that was helped in any way. But now the guard's life was ruined for the five years plus many more after, quite possibly for life. His family's lives were messed up too, quite possibly (not knowing his family circumstances) extremely severely. And his friends again damaged in various degrees (although unlikely any of them were severe).

That could be excused, however, if it were the case that this would have a significant deterrent effect, or some other beneficial result for society or railways or whatever.

Reality is that it won't. The family is still out for blood (again, this seems to be a Liverpool thing especially) and the only thing this will do to improve safety is for a few years guards are going to be super careful at stations, which by the way is probably a net negative thing.

Shows how silly us humans are.

Sorry, but when looking at the report for the Fatal accident at James Street station, Liverpool (R22/2012) and then seeing comments like this on the forum I really have to say that comments such as

"tbh I bet the fact it happened in Liverpool made a difference, they are REALLY into their vengence and general emotion around there"

and

"again, this seems to be a Liverpool thing especially"


are not necessarily the views of all members of this forum and are really bang out of order. It is comments such as this, that continue to pour fuel onto a fire and are best posted somewhere else.
